Are we obliged to collect this data? What if we don't collect this information?

There is no legal obligation to collect this data in the application phase. However, there is the possibility that the lack of some or all of the data may occasionally lead to inquiries or, in the case of permanent lack, the impossibility of setting.

 

Who do we transfer the data to? And: does the data leave the European Union or the European Economic Area?

If you have reached us via one of our external personnel service providers, data may be transmitted to them, whereby we carefully select and check these service providers and bind them contractually in accordance with the legal requirements. We may transfer your data to external service providers who support us in the following activities: storage and management of data, IT support. We ensure that these service providers are carefully selected, contractually bound in accordance with data protection regulations and checked regularly. These service providers also include companies that process your data outside of the European Economic Area or have their headquarters there. For these companies, we only select companies that process the data in locations for which there is an adequacy decision by the Commission (Article 45 GDPR). If this requirement is not met, we only commission these service providers if they provide sufficient security guarantees (Article 46 GDPR), for example by agreeing the EU standard contractual clauses.

 

Why do you save your data for six months in the event of a cancellation?

Of course we don’t like to turn down anyone. In those cases in which this unfortunately happens, we will save your application data for a further six months. In doing so, we refer to Article 6 Paragraph 1 lit.f GDPR. According to this provision, processing is permitted to safeguard the legitimate interests of the person responsible or a third party, unless the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, outweigh this. We derive our legitimate interest from Section 15 (4) of the General Equal Treatment Act (AGG). According to this provision, a claim for compensation after discrimination must be submitted in writing within a period of two months. In the application process, the deadline begins with the receipt of the rejection. In our opinion, if we are not aware of a complaint six months after rejection, it cannot be assumed that such a complaint has been made, so that we are allowed to store the data until then to protect our legitimate interests (defense against a claim for compensation). If you assert a violation of the prohibition of discrimination, we may store data until the process is completed; also this to safeguard our legitimate interests (defense against a claim for compensation)

 

What are your rights?

You have some rights. You have the right to information about the personal data processed about you as well as to correction or deletion, to restriction of processing, to objection to processing and data portability. You also have the opportunity to complain about us to the supervisory authority responsible for us. We politely point out that these rights may be tied to conditions that we will insist on.

Insofar as we address you for advertising purposes, as can be seen in the table above, we refer to Article 6 Paragraph 1 lit.f GDPR. According to this provision, processing is permitted to safeguard the legitimate interests of the person responsible or a third party, unless the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, outweigh this. We derive our legitimate interest from recital 47 of the GDPR, which states, among other things: "The processing of personal data for the purpose of direct marketing can be regarded as processing serving a legitimate interest." With a view to the fact that you are addressed in your work environment and If there is a contractual relationship (or an initial relationship) between our companies, advertising is in our legitimate interest. You have the option to object to the use of your data for advertising purposes at any time, by sending an informal message, for example to the contact details above.
